Dismissed Mumbai Police officer Sachin Waze, who has been declared an approver and pardoned in the case filed by CBI alleging corruption against him and former state Home Minister Anil Deshmukh, sought default bail on Tuesday.
The application filed through advocate Aarti Kalekar sought relief under section 167(2) of the CrPC stating that the agency had not charge sheeted Waze along with the other accused. Therefore, he was entitled to bail.
A day after the court declared Waze an approver, the CBI filed a chargesheet against Deshmukh and his two staffers. However, even if bail is granted, it is unlikely Waze will come out of prison anytime soon as he awaits bail in the case registered by the Enforcement Directorate and National Investigation Agency.
The application is kept for hearing on the June 20 by when the CBI will have to file its reply.
CBI had registered the FIR against Deshmukh and others on April 21, 2021 under Section 7 of the Prevention of Corruption Act and section 120B of the IPC for an attempt to obtain undue advantage for the improper and dishonest performance of public duty.
The agency has accused Deshmukh of corruption in transfers and postings of police officers in Maharashtra. Waze, who was suspended in the early 2000s in a custodial death case, claimed that Deshmukh demanded money to facilitate his reinstatement in the police force on June 6, 2020.
