A Delhi Court on Tuesday remanded accused Naveen Dabas to two days police custody for allegedly being involved in a criminal conspiracy of killing Jitender Jogi in a recent shootout in Rohini Court.
Chief Metropolitan Magistrate Satvir Singh Lamba said that the material and relevant aspects of the alleged conspiracy and the identity of the suspects is yet to be ascertained therefore the police remand is necessary.
"Therefore, considering the facts and circumstances of the case as well as keeping in view the nature of offence, application moved on behalf of IO is allowed in the interest of justice for proper and fair investigation to unearth the entire conspiracy as well as to bring true and real facts of the case on record. Accordingly, the accused Naveen Dabas@ Balli is sent/remanded to police custody for 2 days subject to his medical examination as per rules," the Court said.
The Prosecution alleged that on the instructions of Naveen Dabas Balli, one of his associate namely Naveen Hooda Bhanja brought one "Nepali", who had come to Rohini Court in dress of Advocate with weapons to join the other assailants in order to kill Jitender Gogi.
It was therefore submitted that the custodial interrogation was essential to unearth deep rooted conspiracy as well as to identify and arrest the co-accused persons in the matter.
Advocate Nitin Vashist appeared on behalf of the accused whereas APP Sharawan Kumar Bishnoi appeared for the State.
The allegations in the matter are that in Court Room No. 207 of Rohini Court where one Jitender Maan Gogi was brought for physical hearing, was shot dead by two assailants, namely, Rahul Tyagi and Jaideep inside the Court Room.
The said assailants were neutralized by the vigilant Delhi Police Force after which the FIR was registered under sec. 186, 353, 302, 120B and 34 of IPC and sec. 25, 27, 54 and 59 of Arms Act.
The assailants, who were dressed as lawyers, attacked Gogi when he was brought inside the court room. Witnesses told the media that the judge and the court-staff were present while the horrific incident took place. Visuals of litigants and lawyers fleeing for shelter amidst the shootout have emerged.
The Chief Justice led bench of the Delhi High Court has recently taken suo moto cognizance of the gun firing incident.
Earlier, Justice Rekha Palli had issued notice on a plea seeking directions on Delhi Police and Bar Council of Delhi for taking measures to ensure safety and security of Delhi District Courts, in wake of the firing incident.
