Right To Education: Uttarakhand High Court Orders Online Tuition Course For Juvenile In Children's Home

Emphasizing on the Right to Education for all, the Uttarakhand High Court has directed the Superintendent of the Children's Home in Haridwar to make arrangements for online tuition of a juvenile, willing to enrol for graduation.
"Under Article 21 of the Constitution of India, the Right to Education is a part of the Right to Life," a Division Bench of Chief Justice Raghvendra Singh Chauhan and Alok Kumar Verma observed.
The Bench was hearing a revision petition filed by a juvenile convicted under Section 376-D, 120B, 34 IPC and Section 5/6 of the POCSO Act for the offence of gang-rape.
The revisionist is serving his sentence in the Children's Home at Haridwar. He had moved an interlocutory application, expressing his keenness to pursue his education by doing Bachelor of Arts (B.A.) from the Lovely Profession University, Punjab.
His counsel, Advocate Aditya Singh, submitted that his examinations commence from June 28, 2021 and therefore, the State be directed to make all the arrangements for him to appear in the examinations online from the Children's Home.
"Considering the fact that under Article 21 of the Constitution of India, the Right to Education is a part of the Right to Life, this Court directs the respondent- State to make all the arrangements for the appellant to appear in his examinations scheduled to commence from 28.06.2021, and to continue the arrangements till the examinations are over. The arrangements shall be made at Children's Home at Haridwar," the Bench ordered.
It further directed the Superintendent of the Children's Home, Haridwar to ensure that the Revisionist is allowed to take tuition course online in accordance with the schedule of the tuition classes.
