High Court Directs Rajasthan Police To Refund ₹1.3 Lakh Charged For Relieving Constable-Turned-Teacher

Essentially, after a protracted litigation which led petitioner to remain unemployed for three years, he was initially granted an appointment letter for the post of constable general under the MBC Category. In the meantime, in order to provide support to his family, he again started preparing for other exams and subsequently cleared the REET 2021 exam for the post of Teacher Grad– II (Level 1).

At the counselling process, he was asked to deposit his relieving letter / NOC from the Respondent. In this regard, the Respondent asked the petitioner to deposit an amount of Rs. 1,30,913 spent on his training and remuneration, in order to grant relieving letter / NOC. The petitioner said he was coerced to clear no dues from all the departments and deposited the said amount and got posting in Govt. Upper Primary School, Jana.

Now, the petitioner filed the present writ petition seeking directions to the respondents to refund the recovered amount.

Notably, Justice Rekha Borana disposed of the petition in the same terms Mohan Singh Mohan Singh v. State of Rajasthan & Ors. of this court.

In Mohan Singh, the court had directed the respondents to reimburse the amount of salary (excluding the training expenses) that was recovered from the petitioners, who had resigned to join other State services. The court had asked the respondents to pay interest @ 6% p.a. from the date of recovery till the date of actual payment.

Adv. Shreyansh Mardia appeared for the petitioner while AAG Manish Vyas appeared for the respondents-state.
