The Prayagraj/Allahabad Court on Monday denied bail to the former Welfare Party Of India Leader Javed Mohammad 'Pump' in a case pertaining to the June 2022 Prayagraj Violence incident wherein he has been accused of causing damage to public property.

The Court of Additional Sessions Judge Birender Singh observed that the alleged acts of the accused are anti-social and are of serious nature and hence, he is not liable to be released on bail as there is a possibility that he might tamper with the evidence.

"It is clear from the perusal of the prosecution papers that the allegations against the applicant/accused are that he, along with his co-accused, with the intention of spreading religious hatred and creating resentment towards a particular religion, obstructed government work, damaged public property and caused arson by setting fire to PAC's truck... The criminal history of 14 cases of the accused has been submitted. The above act of the accused is very serious and anti-social. The past conduct of the accused is indicative of his criminal state of mind," the Court said as it rejected his bail plea.

Essentially, this is one of the 5 cases registered against him pertaining to the Prayagraj Violence incident. In this case under Section 147/427 IPC and Section 3/5 of the Prevention of Damage to Public Property Act, Pump has been accused of pelting stones and thereby causing damage to properties belonging to M/S Prayagraj Smart City Limited during the Prayagj Violence.

Before the Court, his counsel argued that he was not named in the First Information Report and that he has been implicated falsely in the case due to political vendetta. It was also submitted that he is a 56-year-old man who is suffering from high blood pressure and diabetes and uses insulin regularly and therefore, he should be released on bail.

On the other hand, the Assistant District Government Advocate, while opposing the bail application, argued that the accused is a vicious criminal who has a criminal history of several cases and the alleged offences are non-bailable and of serious nature and hence, he should not be released on bail.

Against this backdrop, the Court rejected his bail plea.
