PIL Alleges Assam RERA Not Functioning As Per Law: Gauhati High Court Issues Notice To Authority, Its Chairman

Dealing with a Public Interest Litigation (PIL) plea raising the issue that Assam Real Estate Regulatory Authority (Assam RERA), is not functioning in accordance with law, the Gauhati High Court issued the notice to the Authority and its chairman.
The Bench of Chief Justice Sudhanshu Dhulia and Justice Soumitra Saikia was dealing with a PIL moved by Anita Verma submitting that the Authority, which is a statutory authority created under the Real Estate (Regulation and Development) Act, 2016 is not functioning in accordance with the law.
It was also the contention of the petitioner that even a website has not been created by the Assam Real Estate Regulatory Authority, although it is a requirement under Section 34 (b), (c), and (d) of the 2016 Act.
It was specifically argued by the counsel for the petitioner, Senior Advocate U. K. Nair that the authority has no website of its own and due to this, many home buyers may get misled or cheated.
In view of this, the Court issued a notice to the respondent Nos. 4 (The Assam Real Estate Regulatory Authority) and 5 (Chairman, Assam RERA) and listed the matter again on February 03, 2022.
