An Uttar Pradesh-based lawyer S M Haider Rizvi has moved the National Human Rights Commission seeking registration of an FIR against the teacher of a private school in the Muzaffarnagar district of the state, who has been accused of making communal comments and directing her students to slap a Muslim classmate studying in class 2.
This development comes hours after a video of the alleged incident went viral on the internet and the Muzaffarnagar Police has lodged an FIR against Tripta Tyagi (the Teacher of Neha Public School).
A UP-based lawyer has moved the NHRC (@India_NHRC) seeking registration of an FIR u/s 153A, 295A, 298, 323, 504 and 506 against the teacher of a private school in #Muzaffarnagar, who allegedly made communal comments and directed her students to slap a Muslim classmate. pic.twitter.com/5DMaSdZAvk

The complaint moved by Advocate Rizvi has sought registration of an FIR, to be probed by an independent agency, against Tyagi under sections 153A, 295A, 298, 323, 504 and 506 of the IPC. It also seeks compensation to the victim schoolboy and his admission to a school in Delhi or any other district at the state's expense.
The complaint states that the incident reveals a "flagitious" mindset of the teacher who "nurses hatred against a particular community".
"The video, which was circulated on social media all across the globe not only impacts the image and reputation of our country but also casts a blow on the secular fabric of the country, which is already dented considerably because of similar unscrupulous elements whose intent is only to ridicule and mock the country and the administration, with a view to further their nefarious intent of creating a faction amongst the various religious sects which hitherto lived amidst comity and brotherhood," the complaint further states.
It has also been contended in the complaint that the criminal act of the teacher has the potential to create a rift amongst communities creating a riotous situation in the State and the Country, which may have bigger, larger ramifications.
Significantly, the complaint has sought a probe into the matter by an independent agency like the CBI, ATS by claiming that the SSP Muzaffarnagar has "tried to cover up the issue" by stating that the child who was beaten up was not able to learn a particular table and that was the reason why he was beaten up.
"This statement is not only a sham, but a misstatement which is factually also incorrect and goes on to prove that the District Police of Muzaffar Nagar would not be in a position to carry out a free and fair investigation," the complaint further submits.
