Madras High Court Extends Life Of Remands, Bails, Paroles, Interim Orders Subsisting As On April 30

The Madras High Court today resolved to extend interim orders subsisting as on April 30 till June 30.

A Division Bench of Chief Justice Sanjib Banerjee and Justice Senthil Ramamoorthy pronounced the order today in exercise of  the Court's powers under Articless 226 and 227 read with Section 482, 483 CrPC and Section 151 CPC.

Additionally, the Court extended all remands observing, "Since it may not be able to produce remand prisoners under Sections 167 or 307 CrPC before courts either in -person or via VC, all remands stand extended till June 30". The Court clarified that this direction would apply without prejudice to rights of affected person to be released on bail in the meantime.

Interim Orders extended

• The interim orders passed by the Madras High court both at the Principal Seat and the Madurai Bench subsisting on April 30 shall stand extended till June 30, unless vacated or modified earlier, or judicial order to the contrary
• Orders of dispossession, eviction, demolition not executed till date shall remain in abeyance till June 30 unless the stay is expressly vacated or expressly modified by forum
• All orders passed by courts having criminal jurisdiction having granted bail, anticipatory bail, or parole etc for a limited period which are likely to expire on or before June 30, 2020 shall stand extended to June 30, 2021 subject to orders passed by relevant fora even prior to expiry of such date or thereafter, to enable the Courts to deal with any abuse of orders.

Other directions

• The aforesaid directions will be subject to Orders to the contrary passed by the Supreme Court  in individual matters
• In case of extreme hardship, the party aggrieved may apply for discharge or discontinuation thereof before the relevant court
• Interim orders not of a limited duration shall continue to operate and remain unaffected
• Encroachment drives or measures taken for recovery of revenue or demolition or eviction should as far as practicable not be taken by the state and temporarily kept in abeyance except with the previous advice of Advocate General

The matter will be reviewed in the last week of June 2021, the Bench stated.
