The Madras High Court on Tuesday observed that the life of all interim orders shall be extended till August 31 except for orders pertaining to encroachment matters. The order was passed pursuant to the initiation of suo moto proceedings by the Court in Re: Extension of Remand and Interim Orders on May 17.

The development comes less than a month after the Bench comprising Chief Justice Sanjib Banerjee and Justice Senthilkumar Ramamoorthy had earlier specified that the extension of interim orders shall not continue beyond July 15 owing to the improvement in the Covid-19 situation in Tamil Nadu.

However the Court vide its earlier order dated July 13 had directed that the instant suo moto proceedings shall continue so that in case there is a further surge in Covid-19 cases and lockdowns, appropriate measures can be taken to protect the interests of litigants.

On Tuesday the Bench noted that it had been informed by lawyers practising in different district courts that the functioning of the courts across the State had not yet resumed so as to alllow applications for bail and other similar matters to be taken up on an immediate basis.

"Since all courts in the State, including the High Court, are opening up in phases and appearance in physical form is not unrestricted at the moment, it is necessary that the earlier order dated May 17, 2021 should be continued for a further period of at least four weeks", the order stated.

The matter has been listed again on August 31 for further consideration.
