    The Madhya Pradesh High Court on Thursday stayed notification issued by the Madhya Pradesh Public Service Commission (MPPSC) for conducting interviews for the purpose of appointment of Medical Officers in the State of Madhya Pradesh.

    The Bench of Justice S. A. Dharmadhikari was hearing the plea filed by Dr. Ronak Sharma and others being aggrieved by the alleged arbitrary selection process adopted by the MPPSC for the purpose of appointment of Medical Officers in the State of M.P.  

    The counsel for the petitioners argued that that in the advertisement issued by MPPSC for the purpose of appointment of Medical Officers, under the caption "Selection Process", it had been categorically mentioned that the selection shall be on the basis of interview which would be of 100 marks and that written examination shall be conducted only if deemed necessary.

    Taking exception to the aforesaid endorsement, the counsel submitted that selection cannot be made solely on the basis of the interview without any written examination, as it would be in flagrant violation of Article 14 of the Constitution.

    Further, the Counsel relied upon a decision rendered by Constitution Bench (Five Judges Bench) of the Apex Court in Ajay Hasia Vs. Khalid Mujib Sehravardi and others (AIR 1981 SC 487).

    Lastly, he submitted that interviews are going to commence w.e.f. September 27, 2021 and argued that if they would be allowed to be conducted, the purpose of the petition and their chance of getting selected would be frustrated.

    In view of this, the Court stayed further proceedings in pursuance of the notification dated September 17, 2021, of holding interviews September 27, 2021, till November 11, 2021, till the next date of hearing (September 30, 2021).

    The State government has been issued a notice in the matter.
