'Unkind & Condemnable To Turn Down Genuine Request For Adjournment Of Case': Bar Council Of Kerala Writes To CJ Against Justice A. Badharudeen

The Bar Council of Kerala has written to Chief A J Desai regarding the manner in which Justice A. Badharudeen allegedly denied a genuine request for case adjournment on medical grounds to Advocate Jayakumar Namboodiri.
They allege that turning down a genuine request for adjournment of a case due to severe health issues was unkind and condemnable since the other side had no objection to it either.
The Bar Council stated that advocates are an integral part of the justice delivery system and have to be treated with dignity inside and outside the Courts by judicial officers.
The letter mentioned that there were similar incidents of misbehaviour alleged against judicial officers from the District Judiciary and that such behaviour from a judge of the High Court would send a wrong message to them. The Bar Council said that they expect advocates to be treated with courtesy.
Further, it stated that the humiliation suffered by Advocate Namboodiri cannot be ignored and added that many other members of the Bar Council had similar experiences in the courtroom of Justice A. Badharudeen.
The Bar Council has thus sought the intervention of the Chief Justice to prevent such unfortunate incidents in the future.
Earlier, the Kerala High Court Advocates Association (KHCAA) had also written a complaint to the Chief Justice alleging misconduct against advocates in the courtroom by Justice A. Badharudeen for the same issue.
