Kerala HC Directs A Private School To Not Expel Students For Non-Payment Of Fees For Online Classes [Read Order]

The Kerala High Court, taking note of the rather distressing situation that has gripped everyone on account of COVID-19 restrictions, restrained a private school from expelling students, merely for the reason that necessary fees has not been paid yet.
Justice Devan Ramachandran on Tuesday issued interim directions to St Joseph Public School, Manimalamukku, Ernakulam. to permit all the students studying in the school to participate in the online classes and in the upcoming periodic tests pending the disposal of the writ petition.
The petitioners had alleged that the school has expelled the children from the online classes merely on account of their incapacity to pay the full school fees at this time, on account of COVID-19 pandemic scenario.
The Standing Counsel for Central Board of Secondary Education submitted that normally expulsion of students for want of fees is not encouraged.
He seeked permission of the Court to obtain instructions in the matter and inform the Court about the same on the next date of hearing.
The bench also directed the petitioners to inform the court on the next posting date, the time frame within which they are ready to pay the fees.
The matter has been listed for further hearing on 23.09.2020.
