    The Karnataka High Court has dismissed a petition filed in the year 2015 by Praveen Bhai Togadia challenging the prohibitory orders banning him from entering into the Udupi District limits and participating in any Public Meetings/ Functions for a period of seven days, between March 7, 2015 to March 13, 2015.

    Togdia is the National President of Antar-Rashtriya Hindu Parishad.

    A single judge bench of Justice Jyoti Mulimani dismissed as having become infructuous, the petition filed by Togadia and one Baikady Suprasad Shetty.

    The District Magistrate & Deputy Commissioner, exercising the power vested under Section 144 (3) of the Criminal Procedure Code, issued the prohibitory orders banning the petitioner from entering the district from 07th March 2015 to 13th March 2015 on March 6, 2015.

    The authority had banned Togadia from participating in the Hindu Samajotsava rally which was to be held on March 9, 2015. The reason cited by the authorities was to prevent him from giving any provocative speech which might disrupt communal harmony and create law and order problems.

    The petitioner challenged the order on March 9, 2015, the day the speech was scheduled. Then the court had taken up the matter for urgent hearing. However, had refused to grant any interim relief of stay of the order.

    It said “The order was passed by the District Magistrate & Deputy Commissioner of Udupi District, Udupi in the year 2015. Considering that the order impugned has spent itself, no further consideration is required in the writ petition.”
