    The Karnataka High Court recently set aside the practical examinations conducted for the student-petitioners pursuing their final year MBBS course at certain colleges affiliated to Rajiv Gandhi University of Health Sciences (RGUHS), in a plea alleging that the same was not conducted in accordance with law and was done in violation of the University guidelines.

    A single judge bench of Justice MI Arun while allowing a batch of petitions, directed the RGUHS to conduct fresh practical examination for the petitioners in the subjects mentioned in the plea within a period of three weeks.

    The petitioners Basavaraj Itagi and others and petitioners in connected matters had approached the Court stating that they have all succeeded in the theory examination in the final year of MBBS Course. However, they have failed in practical examinations as the same were not conducted in accordance with law. Thus, it was prayed that their results in so far as practical examination should be set aside and the University should be directed to conduct a fresh practical examination for the petitioners.

    Counsel for the University submitted that the University has decided, taking into consideration the interest of the students, without going into the fact whether practical examination has been conducted in accordance with law or not, to conduct fresh practical examination for the petitioners.

    Following which the court set aside the practical/ clinical examination result for the final year MBBS in respect of petitioners.
