'Make Representation Before Concerned Authorities' : Karnataka HC To Doctor Seeking Directions To Use 'Pulse Oximeter' For COVID Test

The Karnataka High Court has asked a Doctor, who had approached the court seeking directions to use pulse oximeter in detecting Covid-19 cases and avoid unwanted swab tests, to approach the concerned authorities with an appropriate representation.
A division bench of Chief Justice Abhay Oka and Justice Aravind Kumar on going through the prayers said "Since most of the prayers made in the petition relate to policy matters, it will be appropriate if the petitioner makes a representation to the concerned authorities who are empowered to take policy decisions on the subjects."
It concluded by saying "We are sure that considering the issue of COVID-19, the concerned authorities will look into the said representations at the earliest and will take appropriate decisions."
The petition filed by DR. CHETAN KUMAR N.G a Pulmonologist had sought directions to the state government and Union government for the use of Pulse Oximeter and to avoid conducting unwanted swab tests, containment zones, seal downs, Night Curfew, etc and to develop a scientific approach in handling the pandemic and avoid unwanted chaos, fear, stigma in the community.
Further, respondents are directed to provide necessary protection such as mandatory health insurance of all including Below Poverty line and Above poverty line. Issue appropriate orders or directions to the respondent to strengthen Primary Health Care centers/taluks/district hospitals in and around Bangalore and rest of Karnaaka to ensure hospitals in Urban areas are not overburdened in future.
Other relief sought included directions to monitor the 6th respondent (THE KARNATAKA STATE PHARMACY COUNCIL) and its members from appointing a committee to ensure that the pharmacist from black stocking any kind of medicines. Respondents, to fix scientifically the bills of Government Scheme cases and make sure the right medications and care are given to such patients referred to the Private Hospitals. Finally, to direct respondents to advise media and news channels to telecast positive news and not create panic among the public."
