    The Rajasthan High Court on Wednesday issued a notice to the Russian Embassy/Government of the Russian Federation on the plea of the wife and children of one Hitendra Kumar Garasiya, who passed away in some accident in Russia and his mortal remains are lying in Russia unattended for the last four months.

    The Bench of Justice Dinesh Mehta took into account the submissions of the Union of India that all the endeavors are being made to ensure that the mortal remains of said Hitendra Kumar Garasiya (petitioners' husband/ father) are brought to India.

    However, it was told to the Court that the authorities at Russian Federation are not handing over the body pending FSL Report.

    Essentially, the Court is dealing with the plea of the petitioners (Asha, Urvashi and Piyush Kumar) who have approached this Court with a grievance that mortal remain of their husband/father late Hitendra Kumar Garasiya, who has passed away in some accident in Russia are lying in Russia unattended since last four months.

    It was their submission that they have been running from pillar to post but of little avail

    In view of this, the Court, in its order observed that since Hitendra Kumar has passed away in July 2021, therefore the Government of the Russian Federation must be requested to expedite the process in this regard.

    While noting that it is not oblivious to its limitations in issuing a writ to respondent No.4 or the Government of Russian Federation, the Court, with a view to deal with a rather unprecedented situation and to coordinate the steps to be taken, thought it expedient to issue notice to respondent No.4.

    The notice has been made returnable on December 20, 2021.
