"I Am Afraid To Go To School Due To Potholes In Roads Near School"-Kerala H.C Takes Cognizance Of Student's Letter [Read Order]

The letter was written by one Mr Aarav M Kamath, a third standard student of St.Juliyanas Public School, Perumpamdappu, Kochi. The letter requested the interference of the court with respect to the road in front of his school, namely the "Pai Road" and "Perumpadappu Road".

In a letter addressed in Malayalam vernacular to Justice Devan Ramachandran, Master Arnav stated as follows:- " I am a 3^rd standard student of St Juliyanas Public School. The road to my school is in a broken and deplorable condition for the past few months . The said road has not been repaired despite many requests. Various potholes have developed in the said road and one of them larger in size is near my residence which is also adjacent to a Nursery school. Instead of repairing the roads the same is filled with casually with metal powder and stones leading to widening of potholes and causing dust pollution in the area. Motorists who fall in to this potholes are increasing day by day. My self and my elder brothers and sisters who accompany me in an auto rickshaw to school are put to great peril fear and danger every time our vehicle falls into one of these potholes .The dust emanating from the metal powder scattered in these holes is further causing serious difficulties to my younger brothers and sisters of the nursery nearby.

Hence I request Judge Uncle to interfere in the matter and to take necessary steps to rectify the Palluruthy-Perumpadappu road in a proper manner, enabling me,my younger brothers and sisters to go to school without fear and dust problems and further ensuring the safety of motorists plying through the area."

Taking cognizance of the letter, Justice Ramachandran had called for the response from the Corporation of Kochi in this regard.The Corporation of Kochi stated that immediate works with respect to the aforementioned roads will be taken up and completed within the shortest span of time considering presence of School children in the area including those studying in nearby nursery.

Taking note of the same, the court observed:- "Learned counsel for the Kochi Corporation, submits that immediate works with respect to these roads will be taken up and completed , particularly taking note of the presence of school children in the area, including those studying in the nearby school. Since this court is now told by all the stakeholders that work is continuing, I do not deem it necessary to issue any further orders at this stage but to adjourn this matter to 15.01.2020, so as to monitor further progress."

The court hence adjourned the matter for further consideration to January 15, 2020.
