The Varanasi Court on Wednesday REJECTED a plea filed before it seeking registration of criminal cases against Samajwadi Party Chief Akhilesh Yadav and AIMIM Chief Asaduddin Owaisi for their alleged remark against 'Shiva Linga', purportedly found inside Gyanvapi Mosque premises in Varanasi last year.

The court of Additional Chief Judicial Magistrate-V (MP-MLA) Ujjwal Upadhyaya rejected an application filed under 156 (3) CrPC by advocate Harishankar Pandey, a resident of Varanasi.
"Regarding the alleged statement of Akhilesh Yadav...and Asaduddin Owaisi...it is sufficient to say that the primary responsibility of law and order lies with the state and its agencies and it is not the case that only the applicant is aware of whether the alleged incident or statements occurred or not. The applicant has also stated about sending the letter. If the State and its agency do not find a situation of law and order, any incitement to violence, then perusal of the application annexed, there does not appear to be any other special ground which would make a violation of the said determination of the State desirable," the court said as it said REJECTED the plea by stressing that no cognizable offence is shown to have been committed.
It may be noted that in his application, the applicant had sought registration of a case against Yadav and Owaisi for allegedly inciting religious hatred by making 'controversial' remarks regarding the structure found inside the Gyanvapi Mosque premises (alleged 'Shiva Linga').
It was his case that SP chief Akhilesh Yadav and Owaisi, his brother, and many others were making objectionable remarks against the 'Shiva linga' which resulted in hurting the sentiments of Hindus.
