Doli Ceremony On Hold: Punjab & Haryana High Court Acknowledges Newly Married Lawyer's Dedication And Grants His Client Bail [Read Order]

The Punjab & Haryana High Court on Wednesday (28th October) acknowledged a Lawyer's dedication and commitment in discharging his duty towards his client, as he waited for his case to be heard by the Court while his (Lawyer's) doli ceremony was on hold.
The Bench of Justice Arun Monga allowed the anticipatory bail application of the client/petitioner "given the inordinate delay in filing the challan by the prosecution".
Apart from this, the Bench also recorded the submission of the Lawyer as to how his Doli Ceremony had been on the hold due to him, since he had been throughout sitting in the video conference, waiting for his turn in the larger interest of discharging his duty to his client.
The Case of the accused/applicant was that despite a lapse of 01 year and 5 months since the date of registration of the FIR, no challan was filed till date and even if the petitioner's custody was allegedly required, he would, therefore, be entitled to default bail.
On a query of the Court with regard to delay in filing of challan, learned State counsel sought adjournment to get instructions qua the same.
In this context, Accused/Applicant's counsel opposed the adjournment and submitted that "he has been sitting since morning waiting for this matter to be heard".
"Notwithstanding his personal difficulty, as he got married only yesterday night, and morning ceremony of Doli has been on the hold due to him, since he has been throughout sitting in the video conference, waiting for his turn in the larger interest of discharging his duty to his client. This court wishes him a blissful and happy married life", the order passed by Justice Arun Monga reads.
Further, the Court ordered,
"Given the inordinate delay in filing the challan by the prosecution, it seems to be a fit case for grant of interim anticipatory bail to the petitioner at this stage."
In the meanwhile, the petitioner has directed to appear before the Investigating Officer and join investigation.
Thereafter, matter was adjourned to 15.12.2020.
