A Delhi Court on Friday allowed an Application moved by Delhi Police seeking for extension of remand of JNU student leader Umar Khalid and Sharjeel Imam in connection with a Delhi Riots case under Unlawful Activities (Prevention) Act and extended the same till 20th November, 2020.
In today's hearing, SPP Amit Prasad informed the Court that there were two applications for remand; one was for Umar Khalid and Sharjeel Imam, and the second was for Faizan Khan, who had been granted bail earlier today by the Delhi High Court.
Post reading the Application, the Judge informed the Counsels as well as the accused that the remand would be extended till 20th November. At this juncture, Advocate Trideep Pais, appearing on behalf of Khalid, sought to make submissions before the Court.
Pais requested the Court to peruse the Application of 14th September which sought for police custody and the Application of 24th September which sought for judicial custody. After comparing the two Applications, he submitted to the Court that it had been copied.
"Thank God for computers. This has been copy-pasted. There is absolutely no application of mind. Even typographical errors have been copied. "Tampering" has become "tempering"", submitted Pais.
He then informed the Court that Khalid had cooperated at every step of the investigation; that he had voluntarily participated and had even made himself available 11 hours before the remand. Further, the grounds that had been listed by the State today were the same as 30 days back and there had been no change.
"There is no question of him absconding. He made himself available from two cities for this. He has a house here, he did his Ph.D from here. Where is the question of him absconding?"
Advocate Surabhi Dhar, appearing on behalf of Imam, made the submissions that the Application of Delhi Police had made no claims about the accused and that Imam had nothing to do with the contents of the FIR; it was just a question of keeping him behind bars.
The Court, after hearing the submissions, allowed the Application and extended the remand of both Khalid and Imam till 20th November.
