    A Delhi Court on Tuesday refused to grant interim relief or protection against arrest in the anticipatory bail plea filed by businessman Navneet Kalra accused in connection to the oxygen concentrators hoarding case and sent the case to the District Judge for deciding jurisdiction of the matter.

    Additional Sessions Judge Sumit Dass was dealing with the jurisdictional aspect concerning the anticipatory bail application filed by Kalra and passed the order after hearing Public Prosecutor Atul Shrivastava and Advocate Vineet Malhotra representing Kalra.

    The Delhi Police had registered a case under sec. 420,188,120B,34 of the Indian Penal Code and sec. 3 and 7 of the Essential Commodity Act 1955 for recovery of over 500 oxygen Concentrators from some restaurants in the national capital. The case has been transferred to the Crime Branch last week.

    The Court had yesterday also refused to grant stay on coercive action against Kalra.

    During the cours of hearing today, Advocate Malhotra, while submitting on the aspect of Jurisdiction, argued before the Court this:

    "This matter was heard yesterday. They say we want to file a reply. They raised an issue of jurisdiction also. Then they had gone to the District Judge for which notice was issued.We appeared before them also.But we argued that the jurisdiction lies with this court only.They can't take the court for a ride for their subsequent jurisdiction. The court cannot be bound by their actions."

    On the other hand, PP Atul Shrivastava that since the case has been transferred to Crime Branch, so the matter should be heard by the CMM. 

    While sending the case to the District Court on the aspect of Jurisdiction, the Court denied interim relief or protection from arrest to Kalra.
