A vacation bench of Justices Anup Jairam Bhambhani and Jasmeet Singh today directed late Bollywood actor Sushant Singh Rajput's father - Krishna Kishore Singh, and producers of the movie "Nyaay: The Justice" to clarify whether the movie has already released or not.
The court was hearing an appeal against a single bench order which refused to restrain the producers from using the name, caricature, and/or likelihood of the actor in the movie.
The film was admittedly inspired from the life of Sushant Singh Rajput. His father moved Court seeking injunction on any and all movies planned, in the pipeline, and to be made in future, from using his son's name, caricature or likelihood - he claimed that as the sole legal heir of his son, he owns celebrity rights hitherto belonging to his son.
Further, he argued that such movies affect his right to privacy, as Rajput's father, as well as the right to a fair trial - in light of various ongoing cases on the cause of his death.
At the outset, the bench remarked that the appeal would not classify as "urgent" anymore, as the film had already released on Jun 11, and also asked of Singh's counsel, Sr. Adv. Jayant Mehta, "If we agree with you, that we disagree with this judgment of the Single Bench, what will we do? Can we un-release the movie? We're just putting to you that the bell can't be un-rung."
On this, while Mehta submitted that his instruction is that the movie has not been released, Adv. Vedant Verma for the producers of Nyaay differed and said the film had already released as scheduled on Jun 11.
To resolve the cul-de-sac, Sr. Adv. Harish Salve appearing for Singh pointed out they could be granted time to clarify the matter.
Agreeing, the Bench said it would hear the matter on Jun 25.
