The Delhi High Court has directed the Union Government and Kendriya Vidyalaya Sangathan (KVS) to sanction the posts of 987 special educators for catering to the needs of 5,625 special children studying in various Kendriya Vidyalayas.
"In order to enable the Kendriya Vidyalaya Sangathan to appoint 987 special educators, eight weeks' time is granted to the Kendriya Vidyalaya Sangathan and to the Union of India to sanction the post of 987 special educators," a division bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad said.
The order was passed in a public interest litigation filed by Social Jurist, a civil rights group, regarding appointment of special educators in KVS schools for children with special needs.
On November 17, the counsel appearing for KVS submitted details regarding all the Kendriya Vidyalayas running across the country and the number of special educators required to be appointed to cater to the needs of special children.
The court was informed that the KVS has engaged 40 special educators on contractual basis and the total number of special educators who are yet to be engaged is 987, for which posts have to be created.
Advocate Ashok Agarwal, representing the petitioner, told the court that it is mandatory for every school to appoint special educators for special children. He submitted that the government has laid down the criteria of appointment of special educators in exercise of powers under Section 20 of the Right of Children to Free and Compulsory Education Act, 2009.
In April, the court had directed the KVS to file an affidavit disclosing the particulars of the special educators who have been appointed, alongwith particulars of the school and number of schools for whom they have been appointed.
The matter will now be heard on March 7, 2023.
