Delhi High Court Seeks Response On Steps Taken To Ensure NGT Orders Banning Sale Of 'Chinese Manjha' Are Efficiently Enforced

The Delhi High Court has sought response of the Centre as well as the Delhi Government over the steps taken by them to ensure that the orders of National Green Tribunal banning the sale of 'chinese manjha' are efficiently enforced.
Justice Yashwant Varma was dealing with a petition filed by a man who had lost his young son on suffering from the fatal injuries caused by Chinese manjha.
The counsel appearing for the petitioner placed reliance on the orders passed by the NGT which had banned the sale of such articles.
It is pertinent to note that the NGT had imposed complete ban on manufacture, distribution, sale and use of nylon or any synthetic manjha or thread holding that the same is lethal in nature and non-biodegradable, in the year 2017.
The Tribunal also directed all State Governments to prohibit the manufacture, sale, store, purchase and use of synthetic Manjha/ Nylon thread and all other similar synthetic threads, used for kite flying.
Noting that evidently the product was still available, the Court directed thus:
"In view of the aforesaid, the respondents would be obliged to place before the Court an affidavit of a competent officer and disclose what effective steps have been taken to ensure that the aforesaid product is no longer manufactured, sold or distributed."
It added that the respondents shall also apprise the Court of the steps that they may have already taken and further propose to take in order to ensure that the directions of the NGT and the orders banning the sale of this pernicious article are effectively enforced.
The matter is now listed for hearing before a roster bench on January 4, 2022.
Earlier this year, the Bombay High Court, Auranagabad Bench took suo moto cognizance on the illegal sale of nylon manjhas on the festive seasons causing severe debilitating injuries to innumerable birds.
Advocates Siddharth Agarwal, Aman Khan, Rahul Jain and Kavita Nailwal appeared for the petitioner. CGSC Ajay Digpaul appeared for the Centre whereas ASC Anuj Aggarwal appeared for the State.
