Delhi HC Issues Notice In Plea Seeking Strict Implementation Of Statutory Reservation For Recruitment In Central Universities

The Division Bench of Chief Justice DN Patel and Justice Prateek Jalan has issued notices to the multiple ministries of the Union of India as well as to the All India Institute of Medical Sciences, Rai Bareilly.

Filed by Samvidhan Bachao Trust, the petition argues that the notification issued by AIIMS, Rai Bareilly, for the direct recruitment for 158 vacant seats violates the Central Educational Institutions (Reservation In Teacher's Cadre) Act, 2019, as well as the provisions of the AIIMS Act, 1956.

It is further argued by the Petitioner that the concerned University has violated the notifications and Office Memorandums issued by the multiple ministries of the Central Government, which may result in inadequate representation for backward classes.

As per the notification dated July 12, 2019, issued by the Ministry of HRD, central universities shall be reserving 15 % of the total posts for Scheduled Castes, 7.5 % for Scheduled Tribes, 27 % for socially and educationally backward classes and 10 % for economically weaker sections.

The petition states:

'there is complete violation of the fundamental rights of the reserved category candidates in conducting direct recruitment through open competition as is evident from the advertisement issued by AIIMS Rai Bareilly.'

The court will next take up this matter on September 24.
