Delhi Court Issues Summons In Suit Seeking Removal Of IMA President, Secretary For Allegedly Bringing Christianity In Statements

A Delhi Court on Saturday issued summons in a suit seeking removal of Dr. JA Jayalal, President and Dr. Jayesh M Lele, Secretary General of Indian Medical Association (IMA) from office bearers for allegedlly maliciously bringing Christianity in the statements given to various news channels/ magazines thereby causing sedition and also for allegedly hurting religious sentiments of people...
A Delhi Court on Saturday issued summons in a suit seeking removal of Dr. JA Jayalal, President and Dr. Jayesh M Lele, Secretary General of Indian Medical Association (IMA) from office bearers for allegedlly maliciously bringing Christianity in the statements given to various news channels/ magazines thereby causing sedition and also for allegedly hurting religious sentiments of people belonging to the Hindu religion by showing comparative superiority of Christianity over Hinduism.
Civil Judge Deeksh A Rao of the Tis Hazari Court ordered thus:
"Notice of the application and the summons of the suit be issued to the defendant through electronic modes on filing of PF within 7 days from today."
The suit filed through Advocate Bharat Malhotra also prays for directions to the National Medical Commission for taking strict action against IMA President, Secretary General and IMA for allegedly carrying out an unethical conduct by ignoring the memorandum and by laws applicable to the IMA and their office bearers.
"That the act of defendant no.1,2 not only hurting the religious feeling of plaintiffs along with crores of hindus but also running a campaign against the Hinduism, Ayurveda & national interest by way of promoting Christianity in India through grabbing post and misusing the position in IMA president as everybody knows that the person, who having higher position can leave great impact on the society even his remarks are attracting penal charges against defendant no.1" the suit reads.
Furthermore, it states:
"It is also important to mention here that the defendant no.1& 2 showing comparative superiority of allopathic medicine over the Ayurvedic medicine as well Christianity over Hinduism. It is also important to mention here that in this terrible situation of covid-19, the defendant no.1 said to crores of Hindus that life is safe only by the grace of Jesus Christ and abusing his position, he has also mislead the medical students as well doctors by defame even a sacred profession like medical, which served & saved numbers of lives."
The plea relies on various news reports published by OpIndia, Indiaspeaksdaily, FirstPost, ChristianityToday, TheDailySwitch etc.and alleges that IMA President is not only known for "Christian evangelism" but also for harbouring "extreme hatred towards sharing misleading claims, cartoons etc for the ruling Party i.e. BJP" including PM Narendra Modi, Health Minister Harsh Vardhan and UP CM Yogi Adityanath.
In view of this, the suit states the following prayers:
- Pass an order granting a decree of permanent injunction in favour of the plaintiffs and against the defendant no.1,2,3 for restraining to use IMA platform or post or individual for propagating any religion & desist them from making any statement to propagate any religion or hurting the sentiments of Hindus or others through any mode.
- Pass an order granting a decree of permanent injunction in favour of the plaintiffs and against the defendant no.1,2,3 to immediately desist from making any derogatory statement through any mode against the Ayurveda treatment hurting the sentiments of Ayurvedic believers like plaintiffs.
- Pass an order granting a decree of mandatory injunction in favour of the plaintiffs and against the defendants to furnish the details of reports, inter alia, showing the basis of the certification or any scientific journal and the details regarding the research or study as carried out or conducted by defendant no.3 at the time of approving/certified the products/brands.
- Pass an order granting a decree of in favour of plaintiffs and against the defendant no.1,2 to tender written apology publically for propagating a religion, through print & electronic media & also direct them to tender written apology publically for making derogatory remarks against ayurvedic medicines or ayurvedic treatment through print & electronic media.
- Pass an order granting a decree in favour of plaintiffs and against the defendant no.1 to restrain him from making any statement to imputation of polytheism in Hinduism & direct him to tender written apology publically for imputation of polytheism in Hinduism through print& electronic media.
- Pass an order granting a decree of mandatory injunction in favour of the plaintiffs and against the defendant no.1,2,3 by directing the defendant no.4 to take all the record of certification/endorsements done by defendant no.3 and submit the detail report & direct defendant no.4 to take strict actions against the members of defendant no.3 for violation bylaws of defendant 3&4.
- Pass an order granting a decree of mandatory injunction in favour of the plaintiffs and against the defendant no.1,2,3 by directing the defendant no.5 to take all the record of certification/endorsements done by defendant no.3 and submit the detail report & direct defendant no.5 to file the complaint against the officials of defendant no.3 for violating the guidelines/bylaws during certification of brands.
- Pass an order granting a decree of mandatory injunction in favour of the plaintiffs and against the defendant no.1,2 by directing the defendant no.4 to remove the defendant no.l & 2.
In a related news, a Delhi Court had earlier this month asked the Indian Medical Association President, Dr. JA Jayalal to not use the IMA platform for propagating any religion and rather to concentrate on welfare of medical fraternity and observed that "saying Christianity and Allopathy are same and is a gift of western world would be the "most inaccurate assertion".
