"How Police Station Converted Into Public Booth?": Delhi Court Pulls Up Police Officer For Calling Party Without Having Formal Complaint

Pulling up a Police Officer for calling a man to the police station without having a formal complaint against him, a Delhi Court yesterday expressed its displeasure by saying that the officer had misled the Court by giving wrong information.

"I fail to understand that how the police station has been converted into public call booth and the duty officer posted therein had acted at the behest of the complainant to call any person without having any complaint against the person," Additional District and Sessions Judge Atul Kumar Garg said.

The Court directed SHO of the police station along with Head Constable and Sub Inspector to appear before it tomorrow along with the complaint received.

"Till then the police is restrained to act on the complaint lodged by the complainant," the judge added.

The Court was dealing with an application filed by a man through Advocate Juhi Arora submitting that he was a victim of continuous, threatening, mental harassment, torturing and blackmailing done by his ex-girlfriend. 

It was his case that the woman had written a suicide note and sent it to him through WhatsApp thereby accusing him for false allegations.

In view of this, it was submitted that he had received a call from the Mehrauli Police Station against a complaint filed by the woman, which according to the applicant, was false in nature.

The concerned investigating officer had previously informed the Court by way of a reply stating that no such complaint or any FIR was registered in the police station.

At the outset, the Court noted thus:

"At this, ASI Sunil who 15 present in the court has stated and admitted that on 20.09.2021, HC Rajesh Kumar was working as duty officer and the complainant had appeared in the PS Menrauli and stated that the applicant has not been picking her call and asked the io ajesh Kumar to call the applicant from police station and HC Rajesh Kumar had called the applicant by dialing the phone and he picked up."

The Court was also apprised that the complaint had been given on Friday by the complainant which was marked to the Sub Inspector for enquiry.

"It appears that the police has been in possession of the complaint on 20.09.2021 itself and he has registered the Complaint only yesterday after seeing the proceedings herein. SHO of PS concerned has misled the Court by giving wrong information," the judge said.

Accordingly, the Court directed that a copy of the said order be sent to worthy DCP of the district for information and necessary action.
