Delhi Court Asks Police Why Compensation Be Not Given To Man Threatened With Arrest Sans Registration Of FIR

A Delhi Court has sought response of the Delhi Police as to why appropriate proceedings should not be initiated against it for compensating a man who was threatened with arrest without registration of an FIR against him.
Additional Sessions Judge Sunil Chaudhary brought the facts into the notice of DCP, North-East for the purpose of intimation and taking appropriate action for non-compliance of order issued by his office, directing SHOs and ACPs to ensure the supply of documents or notice about the purpose of visits to house of any public person.
The development came after the man had approached the Court seeking anticipatory bail apprehending arrest by the officials of Khajuri Khas police station.
It was the case of the applicant that in the month of September 2021, he and his family members received several phone calls from the police station stating that a complaint was made against him and his family members and threatened to arrest them.
Thereafter, the Head Constable had visited the house of applicant and again threatened to arrest him and his family members. However according to the applicant, the officer did not give the complaint to him on his asking.
According to the reply filed by the head constable, it was submitted that he had gone to the area to verify the bail bonds in some other case and was directed by SHO to inquire about the complaint received.
It was also submitted that no FIR was registered against the applicant in the matter.
"There is no report placed before the Court about non registration of the case, if the contents of the complaint were disclosing a cognizable offence giving power to police to investigate the case without orders of the Court," the Court said.
It added:
"The facts are brought into the DCP, North-East for intimation and for appropriate action for non compliance of order/circular issued by his office and meanwhile, the Court is issuing Show Cause Notice to the police, as to why proceedings be not initiated for directing to pay the compensation to the applicant Vipin Kumar who has been forced to approach the Court to move the present application when no FIR has been registered against him in the PS Khajuri Khas."
The matter will now be heard on October 26.
