Can Identification Of Deceased Motor Accident Victims Be Done From 'Specific Characteristics' Available With UIDAI? Delhi HC To Consider

The Delhi High Court is set to examine a legal question as to whether identification of unidentified dead bodies in motor vehicle accident (MACT) cases can be done with the help of specific characteristics available with Unique Identification Authority of India (UIDAI).

A division bench comprising of Justice Mukta Gupta and Justice Anish Dayal appointed Senior Advocate Prashanto Chandra Sen as amicus curiae to assist the Court in deciding the legal issue.

The development ensued in a criminal reference received from the Presiding Officer, Motor Accidents Claim Tribunal on the issue of identification of deceased victims on the basis of specific characteristics available with the Central Identities Data Repository (UIDAI).

The Court issued notice to Additional Standing Counsel, Delhi Government, ASG Chetan Sharma as the nominated Standing Counsel for UIDAI. Notice was also issued to the Member Secretary, Delhi State Legal Service Authority.

The Court has directed the said parties to file their response in relation to the reference before September 27, the next date of hearing.

"Copy of paper book of reference be supplied to the learned Additional Solicitor General, nominated Standing Counsel for UIDAI, learned Amicus Curie and Secretary, DSLSA," the Court ordered.
