Bombay HC To Resume Physical Hearing Of Criminal Appeals Only, Advocates To Be Allowed At A Time, Those Mentioning To Email Praecipe [Read Procedure]

The Bombay High Court on Tuesday notified a special procedure for physical hearing of criminal appeals only from August 31, 2020 to September 15, 2020 for the principal bench in Mumbai, Aurangabad and High Court of Bombay at Goa, as a precautionary measure in view of Covid-19, as cases of coronavirus continue to rise across Mumbai and the state of Maharashtra.
Judges nominated by Chief Justice Dipankar Datta will take up criminal appeals on notified Court working time and dates. Advocates who wish to mention the criminal appeal shall e-mail their praecipe mentioned against the category of the matter. The Advocate shall also serve the praecipe to the other side.
Moreover, a limited number of Advocates will be allowed to enter inside the designated court room at a time and social distancing norms will be observed. Needless to say, wearing of mask is compulsory.
The notice states-
"Till the matter is called out, the Advocates should wait in the waiting room, in which arrangement is made and observe social distancing and use the mask. If one of the Advocate/ party is not willing for physical hearing, then that Advocate/ party can be heard through video conference."
As per the sitting list for the principal seat at Mumbai, the division bench of Justice PB Varale and Justice VG Bisht, the division bench of Justice SS Jadhav and Justice NJ Jamdar along with the single bench of Justice AS Gadkari and single bench of Justice PD Naik will be hearing appeals of different categories between August 31 and September 15.
Notably, on August 19, the Supreme Court Registry wrote to the Supreme Court Advocates on Record Association (SCAORA) communicating the decision of the 7-Judges Committee to resume physical hearings in a limited manner, subject to the decision of the 'competent authority'.
