Lawyers, members of various Bar Associations of Tripura have written to CJI DY Chandrachud requesting him to take steps to fill the vacant posts of judges at Tripura High Court, which has a sanctioned strength of 5 judges and is presently functioning with only 2 judges including the Acting Chief Justice due to transfers and retirements.
The representation signed by a total of 258 advocates highlights that despite the recommendation of transfer of Justice A. P. Singh to Tripura High Court in September 2022 by the Supreme Court Collegium, no effect has been given yet to the said recommendation.
"The Members of the Bar Associations of Tripura are aware, that, the Collegiums of the Hon'ble Supreme Court recommended the names of a good number of Judge for appointment which are now being stuck at a different level and the recommendations of the Collegiums are not being honoured. The law of the land mandates, that, the recommendations of the Collegiums of the Hon'ble Supreme Court should be honoured but unfortunately for some undisclosed reasons, the recommendations are not being honoured," the letter states.
It highlights that due to these judicial vacancies, the forum for intra court appeals is not available.
The representation also urges the CJI to ensure appointment of a full-time Chief Justice to the High Court, at the earliest. The position fell vacant on 10th November 2022 upon superannuation of then Chief Justice. "Unless full strength of the Hon'ble Judge of the High Court of Tripura, is available, the cry for justice for the people of Tripura is going to become illusive," the letter states.
