Andhra Pradesh Advocates Joint Committee Requests CJI To 'Review' Recommendation To Transfer Two HC Judges

The Andhra Pradesh Advocates Joint Committee has sent a representation to the Chief Justice Of India DY Chandrachud requesting him to review the recommendation made by the Supreme Court Collegium to transfer two judges of the Andhra Pradesh High Court.
Essentially, the Committee's letter opposes the recommendation made by SC Collegium (in its meeting dated November 24) to transfer AP High Court's Judges, Justice Battu Devanand (to Madras High Court) and Justice D. Ramesh (to Allahabad High Court).
The Committee has alleged that the decision of the collegium was based upon the government's biased nature toward the two judges as they have, in the past, while exercising their contempt jurisdiction, taken stringent action against the Government Officials for their willful, wanton, and deliberate disobedience of the order of the High Court.
Further, underscoring that both the judges are upholding the constitutional values and independence of the Judiciary while working as Judges of the AP HC, the committee has said that the action of the Collegium system in recommending their transfer is nothing but arbitrariness shown against the transparency of Judicial Independence.
"It is respectfully submitted that we, the members of the committee believe that in-justice is happening to the Judicial Independence in the process of protecting Institutional core values. Moreover, there is apprehension about other Judges who are safeguarding and upholding constitutional values and holding the Benches' at the High Court of Andhra Pradesh and these type of arbitrary Transfers will Impact other Judges in rendering Decisions in order to provide Justice to the public at large," the letter of the committee reads.
