The Allahabad High Court recently asked the Uttar Pradesh government as to whether any recruitment in the police services is under process in the state of Uttar Pradesh and if there is any such ongoing process, then to submit the details regarding the stage of that process.
The Bench of Acting Chief Justice Munishwar Nath Bhandari and Justice Piyush Agrawal was hearing a writ plea registered as public interest litigation (PIL) petition pursuant to the order of the Apex Court regarding the recruitment in the police service.
Importantly, the Supreme Court had, in the year 2019, made a request to the Chief Justices of the High Courts to entertain the matter regarding police service recruitment in the concerned state on the Judicial Side as suo motu Public Interest Litigation and monitor the case from time to time.
The Apex Court had issued this direction in the case of Manish Kumar vs Union Of India And Ors. in which the central issue was regarding the filling up of a large number of vacancies in the different posts in the police forces in the States.
In view of the fact that the Apex Court had given a direction to every High Court to register a Public Interest Litigation for consideration of several issues before it in reference to the recruitment in police service, an order was passed by the Allahabad High Court to register the instant petition as public interest litigation petition.
Referring to the Manish Kumar case (supra), the Allahabad High Court observed that the Apex Court had found that absence of timely recruitment of the Police Officers is causing problems in administration and in maintaining the law and order.
Therefore, the Sanding Counsel was directed to file an affidavit informing as to whether any recruitment in the police service is under process and if it is, the details thereof in regard to the recruitment with stage. Now, the plea has been listed on 19.10.2021 as fresh.
