Apology Accepted- Allahabad High Court Grants Bail To Man Accused Of Forwarding Message Asking People To Display Black Flags To French President

The Bench of Justice Dinesh Kumar Singh was hearing the bail application filed by the applicant in FIR No.548 of 2020 under sections 109, 153-A, 505(1) (b), 505(2) IPC and 67 of I.T. Act.

Accused tenders apology

The Counsel for the accused-applicant submitted before the Court that Accused did not inscribe the message and he only forwarded the objectionable message.

It was further submitted that he wished to tender his unconditional apology for forwarding the message and undertake that he wouldn't indulge in any such activity in the future.

To this, the Court had directed his counsel to file an affidavit of the accused-applicant from jail regarding his unconditional apology stating that he has a firm belief in communal harmony and peace in the society and in the Indian Constitution and Rule of Law.

Pursuant to this, the accused-applicant filed an affidavit, containing the said content from jail and which was placed on record to supplementary affidavit.

Court's order

Considering the facts and circumstances of the case, the accused/applicant tendered an apology and expressed his regret for forwarding the message, inasmuch as the accused-applicant had no criminal history and had been in jail since 07^th November 2020, the Court found it to be a fit case for granting bail.

Lastly, it was directed that the applicant (Mohammad Naeem) be released on bail on his furnishing a personal bond and two sureties of the like amount to the satisfaction of the Magistrate/Court concerned.

In related news, the Allahabad High Court had, in January 2021, granted bail to a Truck Driver named Amar Pal Yadav who allegedly sent a WhatsApp message threatening to kill Uttar Pradesh Chief Minister Yogi Adityanath if gangster Mukhtar Ansari was not released within 24 hours.

Similarly, in December 2020, the Allahabad High Court had granted bail to a 25-year-old youth named Kamran Ameen Khan who allegedly sent a WhatsApp message threatening to kill UP chief minister Yogi Adityanath with a bomb.
