Allahabad High Court Summons Uttar Pradesh DGP In 16-Yr Old Girl's Death Case Who Was Found Hanged In School

The Allahabad High Court today directed the Director-General of Police, Uttar Pradesh to remain present before the Court tomorrow in the case regarding the death of a 16-year-old girl from Mainpuri who was found hanged in her school in the year 2019.

Importantly, while the police had initially claimed that it was a case of suicide, her mother, on the other hand, had alleged that she was harassed, beaten and assaulted, and thereafter hanged. Pursuant to the direction of the Court on August 24, 2021, the members of SIT were present before the court along with the case diary. 

A Bench of Acting Chief Justice Munishwar Nath Bhandari and Justice Anil Kumar Ojha noted that though the FIR of the incident dated 16.9.2019 was lodged on 17.9.2019, the interrogation of the accused was not done immediately or within reasonable time rather it was conducted almost after three months.

Furthermore, the investigating officer present in the Court could not explain the delay in interrogating the accused. The Court remarked that this lag occurred despite serious allegations against the accused.

The Bench was also informed that the then Superintendent of Police, Mainpuri was facing disciplinary inquiry, which was not been completed before his retirement.

"It was due to his misdeeds in the investigation where report came showing semen in the vagina of the girl and sperm in undergarment", said the Court.

When the Court called for the photographs of the girl which, the Court noted, should have been taken at the time of preparation of "Panchnama", it was told that photographs were not available though a video was taken.

To this, the Additional Advocate General Manish Goyal has been asked to arrange for the exhibition of the video in the Court.

Thus, with the view that the SIT team could not independently investigate the matter, the Court directed the DGP to remain present before it along with the members of the SIT team.

The matter will now be heard tomorrow at 10.00 am.
