The Allahabad High Court expressed its anguish at parents who file fake complaints and cases because they could not accept the marriage of choice of their daughter.
"We are pained at recording that cases of such nature are on the rise by the day. A parent or parents do not accept the marriage of choice of their daughter and do not respect the right of their daughter to get married as per her own volition. The right is constitutional.", the bench comprising Justice Ajai Lamba and Justice Rajeev Singh said while allowing a petition filed by girl seeking to quash
In this case, mother of the girl had filed criminal complaints against the boy and his relatives accusing them of kidnapping the girl. The boy and the girl had approached the High Court seeking to quash the FIR lodged against them under Sections 363, 366 and 352 Indian Penal Code. The court noted that the investigating officer had concluded that the victim had neither been kidnapped nor abducted. The High Court then quashed the FIRs.
The court observed that, some parents abuse the process of the law and process of the Court, by filing frivolous complaints and cases with false allegations of committing criminal offence of serious nature.
"Knowing fully well that their daughter has willingly gone with another person of her choice, such proceedings are initiated. Such abuse of process of the Court is required to be prevented by taking not only legal and pragmatic but also realistic view of the matter.", the bench added.
