Allahabad HC Issues Show Cause Notice To An Advocate For Threatening Court Staff

Taking notice of the complaint by a court staff that an advocate had issued threats and used derogatory language against him, the Allahabad High Court has asked the advocate to show cause why he must not be debarred from entering the court premises, pending disposal of notice.

Justice Suneet Kumar said,

"It is informed by my staff that Sri Akash Mani Tripathi, Advocate, appearing for the petitioner in the instant writ petition had approached the office of my staff in my absence today …used derogatory language threatening the members of the staff with dire consequences…threatened of causing injury to the staff outside the Court premises."

Advocate Akash Mani Tripathi was allegedly aggrieved because his order had not been uploaded in a petition filed on behalf of his client, one Padmakar Tripathi, working as an Assistant Teacher in the primary section of a school, seeking his salary under the U.P. High Schools and Intermediate Colleges (Payment of Salaries of Teachers and other Employees) Act, 1971.

In this regard, Justice Kumar observed,

"As a matter of rule, no mentions are accepted in Chambers pertaining to court proceedings or orders. The conduct of Shri Tripathi in threatening the staff is unbecoming of an Advocate."

He therefore issued a show cause notice to the Advocate and called upon him to answer why he must not be debarred from entering the court premises, pending disposal of notice, on October 18.
