The Allahabad High Court on Wednesday extended the operation of interim orders passed it or by the Courts/ Tribunals subordinate to it till October 31, 2020.
A Judicial order to this effect was passed by a Division bench comprising Justices Pankaj Mithal and Rohit Ranjan Agarwal, "in the interest of justice".
Further, the High Court has directed that the period of 90 days during which the caveats filed under Section 148-A CPC remain in force shall exclude the lockdown period and the period in which the working of courts and tribunals have remained suspended or disturbed.
It may be noted that functioning at both the Benches of the Allahabad High Court is under suspension from August 12, and it will continue to remain closed till August 21, due rapid surge in the number of active Coivd cases in the cities.
Under these circumstances the Bench stated that on account of COVID-19 pandemic and the lockdown, regular working of High Court, both at Allahabad and Lucknow, and at most of the District Courts, Civil Courts, Family Courts, Labour Courts, Industrial Tribunals and other Tribunals is disturbed. Thus, it would be appropriate to extend the terms of interim orders passed by any of these Courts, which may be expiring during this period to remain in force till 31.10.2020.
Previously, the High Court had extended the life of all the interim orders till August 31, 2020.
