Aggrieved By Judges' 'Insulting' Behaviour With Lawyers, Allahabad HC Bar Association To Abstain From Work Today

The Allahabad High Court Bar Association (HCBA) has resolved to abstain from work today (Wednesday, July 10), citing its dissatisfaction with the High Court Administration to address a range of pressing issues affecting the advocates, specifically the conduct of certain judges towards bar members.
A decision in this regard was taken in an emergent meeting of the governing council of the association, which was presided over by President Anil Tiwari and Secretary Vikrant Pandey, wherein the following decisions were taken:
(a) The members of the High Court Bar Association, Allahabad shall abstain from judicial work on 10.07.2024 (Wednesday)
(b) For further course of action, the Executive Committee of HCBA will again meet at 05:00 pm on 10.07.2024 (Wednesday)
(c) For all the aforesaid demands, the request letter be sent to Hon'ble The Chief Justice for his Lordship for information and for taking necessary steps, so that corrective measures are ensure.
(d) If any Advocate is found in the court contrary to the resolution, his membership will be cancelled after giving him opportunity by issuing a show cause notice.
A letter was also sent to the High Court Chief Justice requesting that he take immediate action regarding the association's demands.
In the letter to the Chief Justice, the following issues have been raised by the Association
Court conduct of Justice Rohit Ranjan Agarwal in Court No. 69.
The letter states that conduct of Justice Rohit Ranjan Agarwal is against the settled procedure and old tradition of this HC and that he is not following the mandate of Apex Court as laid down in the cases of Pradhani Jani Vs. The State of Odisha 2023 and Kusha Duruka Vs. the State of Odisha 2024. The letter adds that he makes insulting remarks against the Lawyers.
Behaviour of some Hon'ble Judges towards the Lawyers and BAR not proper
The letter to the Chief Justice points towards the growing concerns within the legal fraternity regarding the conduct of certain Judges towards members of the Bar. The letter adds that the behaviour of some Judges has not been proper and has, regrettably, led to a rising sense of resentment among the entire Bar.
The letter also states that despite the president's previous communications and representations addressing these issues, no substantial action appears to have been taken to ameliorate the situation.
Judges not following the tradition to revise the list of Fresh cases or of unlisted cases
The letter has also raised concerns over deviation from certain old practices of the HC, particularly, regarding the listing of cases.
“…the High Court is stretched very far and it has becomes very difficult for many advocates specially the advocates having more than 60 years of age to attend all the courts at the single point of time. Therefore, we demand for restore the tradition of this Hon'ble Court for revising call in all courts practically and not symbolically,” the letter submits.
The letter has also pointed out that the changed process of filing and reporting through judicial orders by the Judges without amending the High Court Rules and contrary to the existing Rules, is creating grave and significant difficulties for the advocates.
Lastly, the association has also raised its grievance regarding the denial of the Registry to provide the Data of Advocate Roll Numbers.
“It is the duty of Bar to enforce the provision of "One Bar One Vote" and to protect and to safeguard the administration of justice by removing unwanted persons and nuisance from the role members of BAR, who have got membership by concealing material facts and also got the Advocate Roll Number from the Hon'ble High but the court administration is not cooperating” the letter submits.
