MP HC Directs MCI And DCI To Give Benefit Of Mid-Session Migration To Students Without Bias [Read Order]

The Madhya Pradesh High Court has directed the MCI and the DCI to give benefit to students seeking migration from one college to another during mid-session by strictly adhering to norms in a uniform manner without discrimination.
With this direction the court disposed of a petition claimed the Medical Council of India (MCI) and the Dental Council of India (DCI) had granted benefit of migration in undeserving cases to the children or relatives of Ministers, IAS and IPS officers while the same is denied to others.
In their affidavits, the MCI and DCI stated “they shall in future be careful and vigilant in exercising this power and that they shall not give any undue benefit to the relatives and children of the ministers, IAS or IPS officers”.
Also the MCI and DCI stated “they shall apply these regulations to all category and class of students”.
However, the court declined to pass any order over the petitioner brought to the notice about benefits granted to certain respondents.
The court observed those are “stale and old cases at this stage no decision or order in respect of the benefit granted to respondents 6 to 11 is required to be or can be given by this Court”.
A division bench comprising Justice RS Jha and Justice AK Joshi said “we are not required to examine the validity of any order of migration in the present petition”.
“The MCI and the DCI to strictly adhere to the regulations relating to migration, by implement them in a uniform manner without discrimination and ensuing that they are not utilized for the purposes of granting benefit only to high placed individuals and that they are exercised only in cases which fulfill the criteria”, the court directed.
