MP HC Asks DGP To Ensure Timely Submission Of FSL And DNA Reports In Trial Courts [Read Order]

In a significant order, a single bench of MP High Court has directed the State Director General of Police (DGP) to ensure timely submission of reports pertained to FSL, DNA and handwriting examination before the trial courts in several pending criminal cases across the State.The reason for issuing such direction to DGP, the court said “the delay in the trial may be avoided and the cases should not be disposed of in absence of the reports”.Moreover the court said “the timely submission of such reports should also be included in the list of inspection to be done by higher officers yearly”.The court’s directives to the DGP came after perusal of the report it sought in this regard.The court while going through the report found till 30.4.2017 as many as 731 samples for FSL, 24 samples for DNA and 1746 samples for hand writing examination are pending since last more than one month.Furthermore the court directed the DGP to seek reports from the superintendent of police in districts where there is unusual delay in submission of such reports before the trial court.The DGP is also asked to issue instructions to the superintendent of police of each district to monitor these issues and pendency of reports.Justice JP Gupta said “on perusal of the report it is found that there is a direction to collect the samples and send them for analysis through the superintendent of police and produce before the trial court after receipt of the analysis report”.“But it appears that there is no specific mechanism or system to check the moment of the samples to ensure timely submission of reports before the trial court”, the court held.The court issued the directions while granting bail to the applicant accused in rape and murder case of Sohagpur in district Hoshangabad where there was delay in submission of his DNA report.Read the Order here.
