Delhi High Court Grants Injunction Against Book Publication

    Karanjawala & Co., Advocates, successfully obtained temporary injunction from the High Court of Delhi on behalf of its client St. Xaviers Trust against publication and sale of a book authored by Ms. Leena Dhankhar, journalist, published by Juggernaut Publications and being sold on e-commerce websites Amazon and Flipkart.

    The injunction was obtained on the contention that the book was defamatory and contrary to the orders of the Ld. Additional Sessions Judge, Gurugram, who had directed the names of the school, victim and accused be kept private to ensure confidentiality. It was further contended before the Hon'ble High Court of Delhi that in keeping with the law laid down by the Hon'ble Supreme Court of India, the Courts have the power to grant injunction even in cases where the book/article is in the process of pre-publication.

    The Hon'ble High Court of Delhi concurred with the view presented before it and directed/injuncted the publishers from publishing, packaging, releasing, offering for sale, selling & displaying on their website the said book and further directed/injuncted online e-commerce websites Amazon and Flipkart from accepting any purchase orders and executing the pending orders.
