    The National Company Law Tribunal (“NCLT”) has issued a circular dated 01.09.2023, intimating that its previous circular dated 29.08.2023, whereby E-filing system underwent changes through introduction of ‘Mandatory Pre-Requisite’ on filing, has been kept in abeyance till 15.09.2023.

    The step has been taken in view of a request made from the NCLT Bar Association to the Hon’ble President, NCLT.

    In the meanwhile, the NCLT will hold a webinar to disseminate information for guidance of Counsels/stakeholders. The date and time of webinar would be updated on the website of NCLT.

    The Circular dated 29.08.2023 was previously made effective from 04.09.2023, however, now the date has been postponed.

    Brief background

    On 29.08.2023, the NCLT vide a circular had introduced instructions named as ‘Mandatory Pre-Requisite’, which brought changes in the E-filing system of NCLT.

    The Litigants/Advocates/Parties were requested to follow the ‘Mandatory Pre-Requisite’ on formatting, book marking of pleadings, use of electronic signatures, retention of originals etc., at the time of filing, which was to be effective from 04.09.2023.

    As per revised terms, the PDF version of documents are made mandatory for filing, followed by electronic signature using Digital Signature Certificate (DSC) issued by Certifying Authority. The provision of e-sign based on Aadhaar authentication shall be made available as an alternative to DSC in the due course.

    A detailed instructions on the ‘Mandatory Pre-Requisite’ for filing was also attached alongwith the earlier Circular.
