Telangana High Court Suspends Look-Out Circular Against Ex-MLA Accused Of Helping His Son Escape From Scene Of Accident

The Telangana High Court suspended the Lookout Circular issued against Ex-MLA Shakil Aamir, which was issued on the allegations that he helped his son escape the scene of an accident.
On 24th December 2023, it is alleged that Sahil Raheel Aamir met with an accident in a prominent locality of Hyderabad, outside the Praja Bhavan. Although there were no casualties, it is alleged that Shakil Aamir, in an attempt to protect his son, tried to replace his presence at the scene of the crime with that of the family driver due to which, the incident garnered substantial attention.
Owing to such allegations an FIR was registered under various sections such as s.308 (culpable homicide), s.419 (cheating by personation), etc, of the IPC, read with corresponding sections of the Motor Vehicles Act, 1988.
The order was passed by Justice K. Lakshman in a plea filed by the Ex-MLA and other accused in the crime praying that the LOC issued against them be quashed.
Noticeably, the father-in-law and the son of the accused ex-MLA have both approached the High Court challening the same FIR and the procedure adopted by the officials in inspecting the matter.
Abdul Asif the father-in-law of the accused approached the Court praying stay of investigation against him. The court while declining to grant a stay directed the authorities to investigate the matter per law. Sahil Raheel Aamir the son of the Ex-MLA approached the Court praying that the FIR registered against him be quashed, however, the petition was withdrawn.
The prosecution in the present petition and the petition filed by Abdul Asif argued that there are serious allegations against all the petitioners as they are trying to shield Sahil by replacing him at the scene of the alleged crime with the family driver.
The senior counsel in the present matter representing the petitioners submitted that the petitioners were willing to come to India and cooperate with the Investigating Officer. Owing to this submission, the court has directed the police not to arrest the accused under the guise of the LOC or on any other ground till the 23rd of February.
The Court has also directed that the present writ be listed along with the writ filed by Abdul Asif, in which the defacto complainant was directed to be impleaded.
While adjourning the matter the Court reiterated that the investigating officers must conduct the investigation strictly in accordance with law.
