Telangana High Court Orders Action Against Off-Campus Centre Of Malla Reddy University For Being Established Without Prior Sanction Of State Govt, UGC

The Telangana High Court has passed interim direction to the State and the University Grants Commission (UGC) directing them to take action against the Malla Reddy University, Center of Excellence for Commerce and Design an off-campus centre of the Malla Reddy University, for having been established without the prior sanction from the State of Telangana and the University Grants Commission.
The order was passed by Justice C.V. Bhaskar Reddy in a plea filed by the Naveena Educational Society and Prathibha Degree College praying for the immediate closure of the Malla Reddy University, Center of Excellence.
Consequently, it was prayed that strict action be taken against the University for running an off-campus centre in violation of UGC (Establishment Of And Maintenance Of Standards In Private Universities) Regulations, 2003
On a previous occasion, the Bench had ordered notice in the matter. However, on the present date, the Bench was informed that the university representatives chose not to accept the notice, and hence notice against them was deemed served.
Thus, the Bench noted:
“The case of the petitioner is that as per the provisions of University Grants Commission (establishment of and maintenance of Standards in Private Universities) Regulations, 2003 (hereinafter referred to as "the Regulations, 2003") respondent is required to obtain necessary permission for establishing off campus centre. The grievance of the petitioner is that contrary to the said Regulations, 2003, respondent…… In view of the above submissions and since there is no representation for respondent Nos.7 and 8 even after receipt of the notice and as respondent No.7 is not having any permission to open the off campus centre i.c., respondent No.8 as per the Regulations, 2003, there shall be interim direction to respondent Nos.2, 3 and 5 to take appropriate action against respondent Nos.7 and 8 in terms of the Regulations, 2003.”
The writ petition has been listed on 24.07.2024 for filing of counter affidavit.
