    While hearing a writ petition challenging the Round 3 of Counselling of NEET PG- 2024, the bench of Justice Sameer Jain at the Rajasthan High Court issued notices to the Director, (Public Health), Medical and Health Service, Rajasthan and the Chairman, NEET PG Admission/Counselling Board.

    The petition has been filed by the candidates of the NEET PG 2024 who had participated in the counselling process following the examination, alleging that Clause 2(ii) of the Instruction booklet for State PG State Medical PG Seats was violative of Articles 14, 19 and 21 of the Constitution.

    The Clause stipulated that any seats remaining vacant after the 3rd round of counselling shall be filled in the stray round without applying the state eligibility criteria and not being open to all the NEET PG 2024 qualified candidates.

    It was argued on behalf of the petitioners that as a result of this Clause, meritorious candidates who would have gotten a seat which was vacant after round 3 would either not get that or would have to pay an exorbitant cost for the same. Furthermore, it was also argued that since the vacant seats would directly go to the stray round wherein the petitioners could not participate, those will be allocated to candidates who secured much lower rank, creating a window of disparity.

    Highlighting the fact that no other state had incorporated such a clause in the Instruction booklet, the act of the State was alleged to be violative of Article 14, 19 and 21.

    In this background, the Court issued notices to the Director, Rajasthan Health Services and the Chairman, NEET PG Admission/Counselling Board, listing the matter for February 15, 2025.
