    The Punjab and Haryana High Court has dubbed as "frivolous" the application to recall its order paving way for Central government to take action against IIM Rohtak's Director Dheeraj Sharma for allegedly concealing that he is not qualified for the post.

    The High Court had lifted a bar on the Union Government to take action against Sharma, accused of concealing that he did not have a first-class bachelor's degree, a necessary qualification for the post. This was after as many as six adjournments were sought from Sharma's side.

    He now again preferred this application seeking recall. This prompted Justice Vinod S. Bhardwaj to remark,

    "the instant applications have now been filed notwithstanding that a cost of Rs.30,000/- had already been imposed upon the petitioner earlier for not advancing the arguments on one occasion and as many as two last opportunities had also been granted. I find that the applications filed in this manner are wholly frivolous and unnecessarily clog the over-burdened docket of the Courts."

    During the hearing, the senior counsel appearing for Sharma sought withdrawal of the application so as to take all the pleas at the time of final hearing in the writ petition itself.

    The Court noted that he also voluntarily undertook to donate medical equipments worth a minimum of Rs.2 Lakhs as may be conveyed by the Civil Surgeon, Government Hospital, Rohtak, within a period of 04 weeks of such demand.

    The bench dismissed the application as withdrawn but bound the applicant with the voluntary undertaking of donating medical equipment.
