    The Punjab & Haryana High Court has issued slew of directions for conducting the no-confidence against Chairman of Faridabad block samiti tomorrow (January 24).

    Suspecting horse-trading the plea filed by the Chairman challenged the notice to postpone the No-Confidence Motion meeting from January 13 to January 24.

    Justice Sudhir Singh and Justice Sukhvinder Kaur noted that it is the second round of litigation, again challenging notice for convening the No-Confidence Motion and it appears that the petitioner, for one reason or the other, wants to avoid the meeting for the No-Confidence Motion.

    Speaking for the bench Justice Sudhir Singh issued a slew of following directions:

    i) The respondents-authorities shall conduct the meeting for No Confidence Motion on the scheduled date and time ie. 24.01.2025 at 11 a.m. as indicated in the notice 14.01.2025.

    ii) The Additional Deputy Commissioner, Faridabad, shall ensure that the scheduled meeting is held under the supervision of the Competent Authority.

    The members coming forward to participate and vote in the No Confidence Motion, shall be provided adequate security so that no untoward incident takes place in the meeting.

    iv) The Commissioner of Police, Faridabad, shall ensure that adequate security is provided at the place of meeting and to the members participating in the meeting and shall also ensure that no ruckus takes place in or around the premises of the place of meeting, prior to, during or after the No Confidence Motion.

    v) The entire proceedings of the meeting of No Confidence Motion, shall be videographed by the Official Respondents.

    The Court noted that, a similar plea was also filed earlier by the petitioner, Bhagrathi, the Chairman of Block Samiti wherein apprehensions of horse trading were raised while challenging an earlier notice for calling no-confidence motion meeting. However, the plea was withdrawn.

    In the present plea, the petitioner had challenged the notice for postponing the schedule of no-confidence motion.

    Perusing the response of State, the Court noted that the competent authority i.e. Chief Administrator, HSVP was on medical leave, hence the meeting for no-confidence motion could not be conducted at the earlier scheduled time.

    "We, thus, find no reason to postpone the date fixed for the No confidence motion fixed on 24.01.2025," the Court added.

    While disposing of the plea, the Court directed the Bench Secretary, to hand over the copy of order to the State Counsel, forthwith, for onward communications and necessary compliance by the concerned Authorities.
