The Punjab and Haryana High Court has directed to initiate departmental enquiry against Deputy Superintendent of Police of Haryana's Tauru for furnishing wrong facts in a status report filed before the Court.

Observing that it has become routine to furnish false information, Justice Deepak Gupta directed the DGP, Haryana to “proceed departmentally against Shri Mukesh Kumar, Deputy Superintendent of Police, Tauru for filing false affidavit before this Court, under intimation to this Court.”

The Court was hearing a bail application pertaining to a case where a scuffle between two groups in a village took place and gunshots were fired. Two men were killed and an FIR was lodged against several people.

In the present bail petition filed by one of the accused, the Court sought a status report from the DSP. In the report the DSP submitted that “no bullet was recovered from the body of any deceased.”

Justice Gupta noted that counsel for the complainant had highlighted that as per the FSL report it is specifically mentioned that one of the parcel received by it for the purposes of analysis contained pellet which was stated to have been taken from the body of one deceased and thus status report filed by the State is contrary to the FSL report.

The Court had directed the investigating officer to appear and clarify about the above contradiction.

The counsel appearing for the State tendered unconditional apology on behalf of DSP and stated that the status report was filed on the basis of wrong information.

Adding that it is being noticed by the Court that it has “become a routine to furnish wrong information in the Court in numerous cases”, the Court directed to initiate departmental enquiry against the DSP.

The matter is now listed for November 9, for further consideration.

Appearance: Sarfraj Hussain, Advocate for the petitioner.

    Parveen Kumar Aggarwal, DAG, Haryana.

Anmol Partap Singh Mann, Advocate for the complainant.
