Supreme Court Collegium Recommends Transfer Of Justice Nani Tagia To Patna High Court, Declines Request For Alternate Posting

On Thursday, the Supreme Court Collegium recommended the transfer of Justice Nani Tagia from the Gauhati High Court to the Patna High Court.

The Collegium consisted of Chief Justice of India Dhananjaya Y Chandrachud, Justice Sanjay Kishan Kaul, Justice Sanjiv Khanna, Justice B R Gavai and Justice Surya Kant.

On 23 August 2023, the Collegium had proposed the transfer of Justice Tagia to the Patna High Court.

The resolution stated that in terms of the Memorandum of Procedure, the SCC consulted the Judges of the Supreme Court who, being conversant with the affairs of the Gauhati High Court, were in a position to offer views on the proposed transfer. The Chief Justices of the Gauhati High Court and Patna High Court were also consulted.

By a communication dated 24 August 2023, Justice Nani Tagia had requested that he may be allowed to remain at any of the Benches of the Gauhati High Court or be transferred to the High Court of Tripura.

"We have considered the request made by Mr Justice Nani Tagia. The Collegium does not find any merit in the request made by him. The Collegium, therefore, resolves to reiterate its recommendation dated 23 August 2023 to transfer Mr Justice Nani Tagia to the High Court of Judicature at Patna," the resolution said.
